Blades of Virtue (“BoV”) provides its service to you (either an
individual or a single entity), subject to the following Terms of Service
("TOS"). We may amend this Agreement at any time by posting the amended terms on
Our Site (please see “MODIFICATION” for more details). The amendment shall
automatically become effective three (3) days after they are initially posted on
Our Site.
By installing, copying, downloading, accessing or otherwise using
the software, you agree to be bound by this TOS. If you do not agree to the TOS,
do not install or use any portion of this software or it’s services.
1)
REGISTRATION OBLIGATIONS
You agree:
a) That
You are at least 16 years of age, or have a parent of legal guardians permission
to access the services of Blades of Virtue;
b) To
provide true, accurate, current and complete information as prompted for
registration
Non-compliance with any of these obligations during the
maintenance of your account may result in the suspension or termination of your
account, and may result in the refusal of any and all current or future use of
Blades of Virtue services, or any portion thereof at the sole discretion of
Blades of Virtue.
2)
PRIVACY POLICY
a) The database and certain other information about you may be disclosed only if such action is reasonably necessary to comply with the law, legal process or to enforce the TOS. Your information is collected solely for Blades of Virtue, and will not be used for any other purpose or by any other entity with exception that that which we find reasonably necessary to comply with the law, legal process or to enforce the TOS.

MEMBER ACCOUNT INFORMATION
a) You
will receive a confirmation number, password and account designation by the
email address that you provide upon completing the registration process. You are
responsible for maintaining the confidentiality of the password and account, and
are fully responsible for all activities that occur under your password or
account.
You agree to:
i)
Immediately notify Blades of Virtue of any unauthorized use of your
password or account or any other breach of security.
ii)
Ensure that you exit from your account at the end of each session. We
will not be liable for any loss or damage arising from your failure to comply
with this section.
4)
MEMBER CONDUCT
a) You
understand that all information, data, text, software, music, sound,
photographs, graphics, video, messages or other materials ("Content"), whether
publicly posted or privately transmitted, are the sole responsibility of the
entity from which such Content originated. This means that you, and not Blades
of Virtue, are solely responsible for all Content that you upload, post, email
or otherwise transmit via Blades of Virtue software, http://www.BladesofVirtue.com,
http://forum.BladesofVirtue.com and all other subsidies thereof. We do not
control the Content posted and as such; do not guarantee the accuracy, integrity
or quality of such Content. You understand that by using Blades of Virtue, you
may be exposed to Content that is offensive, indecent or objectionable. Under no
circumstances will Blades of Virtue be liable in any way for any Content,
including but not limited to, any errors or omissions in any Content, or for any
loss or damage of any kind incurred as a result of the use of any Content
posted, emailed or otherwise transmitted via the System.
b)
You agree to not use Blades of Virtue to:
i) Upload,
post, email or otherwise transmit any Content that is unlawful, harmful,
threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive
of another's privacy, hateful, or racially, ethnically or otherwise
objectionable.
ii) Harm
minors in any way.
iii) Impersonate
any person or entity, including, but not limited to, a Blades of Virtue
moderator, developer, SysOp, administrator, official, forum leader, guide or
host, or falsely state or otherwise misrepresent your affiliation with a person
or entity.
iv) Upload,
post, email or otherwise transmit any material that contains software viruses or
any other computer code, files or programs designed to interrupt, destroy or
limit the functionality of any computer software or hardware or
telecommunications equipment.
v) Disrupt
the normal flow of dialogue, cause a screen to "scroll" faster than other users
of Blades of Virtue are able to type, or otherwise act in a manner that
negatively affects other user's ability to engage in real time exchanges.
vi)
Interfere with or disrupt the Blades of Virtue servers or networks
connected to Blades of Virtue, or disobey any requirements, procedures, policies
or regulations of networks connected to the Blades of Virtue server network.
vii) Intentionally
or unintentionally violate any applicable local, state, national or
international law;
viii) "Stalk" or otherwise harass another.
ix) Collect
or store personal data about other users.
x)
Promote or provide instructional information about illegal activities,
promote physical harm or injury against any group or individual, or promote any
act of cruelty to animals.
xi) Serve
Porn or other questionable content. The quote of "porn" is solely decided by
admin of Blades of Virtue. c) As POSTED in “Rules & Regulations

SPECIAL CONSIDERATIONS FOR INTERNATIONAL USE
a) You
agree to comply with all local rules regarding online conduct and acceptable
Content. Specifically, you agree to comply with all applicable laws regarding
the transmission of technical data exported from the United States or the
country in which you reside.
b) You
agree to use the English language, text on all pages.

INDEMNITY

MODIFICATIONS TO SYSTEM
Blades of Virtue reserves the right at any time to modify or
discontinue, temporarily or permanently, service, or any part thereof with or
without prior notice. You agree that Blades of Virtue shall not be liable to you
or to any third party for any modification, suspension or discontinuance of
service.
8)
TERMINATION
You agree that Blades of Virtue may terminate your password,
account and/or use of service and remove and discard any Content within Blades
of Virtue, for any reason, including, without limitation, for lack of use or if
Blades of Virtue believes that you have violated or acted inconsistently with
the provisions of the TOS. Blades of Virtue may also, at any time, discontinue
providing service, or any part thereof, with or without prior notice. You agree
that any termination of your access to Blades of Virtue under any provision of
this TOS may be effected without prior notice, and acknowledge and agree that
Blades of Virtue may immediately deactivate or delete your account and all
related information and/or bar any further access to Blades of Virtue. Further,
you agree that Blades of Virtue shall not be liable to you or any third-party
for any termination of your access.
9)
DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
a) YOUR
USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS"
AND "AS AVAILABLE" BASIS. Blades of Virtue EXPRESSLY DISCLAIMS ALL WARRANTIES OF
ANY KIND, WHETHER EXPRESS OR IMPLIED.
b) ANY
MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SYSTEM IS DONE
AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY
DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF
ANY SUCH MATERIAL.
10)
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT
SHALL BLADES OF VIRTUE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR
CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR
LOSS PROFITS, INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE
OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE FAILURE TO PROVIDE SUPPORT
SERVICES, EVEN IF BLADES OF VIRTUE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.
11)
MODIFICATION
Blades of Virtue may modify any of the terms and conditions
contained in this TOS or the End-User License Agreement (“EULA”) at any time and
in our sole discretion. A notice of change will be posted on our web site
(http://www.bladesofvirtue.com OR http://forum.bladesofvirtue.com) and shall be
effective three (3) days after they are posted on our site.

COPYRIGHTS and COPYRIGHT AGENTS
Blades of Virtue respects the intellectual property of others,
and we ask our users to do the same. If you believe that your work has been
copied in a way that constitutes copyright infringement, please provide Blades
of Virtue 's copyright agent the following information:
a) an
electronic or physical signature of the person authorized to act on behalf of
the owner of the copyright interest;
b) a
description of the copyrighted work that You claim has been infringed;
c) a
description of where the material that You claim is infringing is located on the
site;
d) Your
address, telephone number, and email address;
e) a
statement by you that you have a good faith belief that the disputed use is not
authorized by the copyright owner, its agent, or the law;
f) a
statement by you, made under penalty of perjury, that the above information in
your notice is accurate and that you are the copyright owner or authorized to
act on the copyright owner's behalf.
13)
GENERAL INFORMATION
This TOS constitutes the entire agreement between you and Blades
of Virtue and governs your use of Blades of Virtue, superceding any prior
agreements between you and Blades of Virtue. The TOS and the relationship
between you and Blades of Virtue shall be governed by the laws of the State of
Victoria, Australia without regard to its conflict of law provisions. The
failure of Blades of Virtue to exercise or enforce any right or provision of the
TOS shall not constitute a waiver of such right or provision. If any provision
of the TOS is found by a court of competent jurisdiction to be invalid, the
parties agree that the court should proceed to give effect to the parties'
intentions as reflected in the provision, and the other provisions of the TOS
remain in full force and effect. You agree that regardless of any statute or law
to the contrary, any claim or cause of action arising out of or related to use
of Blades of Virtue or the TOS must be filed within six (6) months after such
claim or cause of action arose or be forever barred.
14)
COPYRIGHT NOTICE
The documents and information of Blades of Virtue, affiliated
software, web sites (http://www.bladesofvirtue.com &
http://forum.bladesofvirtue.com) and other correspondence are copyrighted
materials of Blades of Virtue. Reproduction or storage of materials retrieved
from Blades of Virtue or any affiliates is subject to the U.S. Copyright Act of
1976, Title 17 U.S.C. Blades of Virtue and the Blades of Virtue logo are
trademarks of Blades of Virtue. All rights reserved.
15)
VIOLATIONS
Any violations of the TOS should be reported to Blades of Virtue
at admin@bladesofvirtue.com. In the event that you breach any of the above
provisions of this agreement, you agree that Blades of Virtue may terminate your
use of our services in part or entirety at Blades of Virtue’s sole discretion.
